Construction Law

Construction projects are complex endeavors involving countless details, contingencies, and variable conditions. Contractors and their customers rely on effective construction contracts to lay the groundwork for effective business relationships. We prepare comprehensive construction contracts for builders and their customers. When project delays and claims of defective construction occur during or after the project, we represent the interests of contractors, developers, and property owners in litigation. We assist clients on all sides of construction project litigation. When complaints and legal claims arise during or after construction, we provide compelling representation in settlement negotiations and in civil court.

1. Construction transactions

Construction contracts – representing all parties in the review, negotiation, and drafting of construction agreements

Mechanics liens – assisting small and mid- sized subcontractors who have not been paid by general contractors

2. Construction litigation

Defective construction – including waterproofing, mold

Unsuitable soils – defective site conditions

Delayed projects – stop notices

Breach of contract – disputes between property owners, general contractors, sub-contractors, suppliers

Construction site accidents – serious injury and wrongful death claims

3. Mechanics Liens

Do you need to place a mechanics lien on a property you worked on? Is the purchase or sale of your home hung-up due to an expired lien? We assist all parties in real estate matters involving mechanics liens and handle the documentation and filing procedures required to place or remove mechanics liens. We represent contractors who have not been paid by developers or other property owners. We represent sub-contractors who have not been paid by general contractors. We also represent property owners when a cloud on the title is preventing a purchase, sale, or other real estate transaction. We assist smaller contractors who may not be familiar with the mechanics liens filing process or who do not want to spend valuable time filing the necessary paperwork. We serve construction contractors with quick and efficient handling of mechanics liens and offer cost-effective processing in the New York metro area. When debts are paid to a contractor who has filed a lien on a property, the title should be cleared. But many times the cloud will remain on the title preventing the sale of the property. In such cases, we pursue lien releases and help the property owners secure clear titles for their properties.
