New York law requires anyone offering such services for a fee to enter into a contract outlining the services they will perform and the fees they will charge. The service provider is prohibited from taking any money from you until they have completed all promises.

Be aware that New York law requires your lender to provide two notices to you. One will come 90 days prior to you receiving a Summons and Complaint notifying you of a foreclosure action and the other will come with the Summons and Complaint, should you continue in default. Both notices will inform you that there are several options available to help you keep your home. They will provide you with a list of government approved housing counseling agencies in your area that provide free or very low cost counseling. These notices will direct you to the state or suggest that you contact other government agencies and nonprofits that may offer you free services to help you understand your options.
